Sir, Marcel C. Dim-Udebuani Esq. Legal Adviser; Nzuko-Ora Nnewi, reacting to a press statement by Hon. Augustine Onyekachukwu Ike, KSJI, Member Representing Nnewi North Constituency, Anambra State House of Assembly and Chairman, Youth Development and Sports, https://kubwaexpress.com/2024/10/11/hon-augustine-onyekachukwu-ike-ksji-member-representing-nnewi-north-constituency-petitions-magistrate-adaeze-eze-calls-for-disciplinary-action/,  has urged Gov. Soludo to discountenance the Press statement of Hon. Augustine Onyekachukwu Ike, KSJI.
According to Udebuani Esq, “, as a member of House of Assembly, Hon. Sir. Augustine Onyekachukwu Ike ought to have known that the purported press release is contemptuous Ex-facie curiae because the cases he mentioned in his press release are subjudice.”
He further asked that the Speaker of Anambra State House of Assembly, compel Hon. Ike, to “retract the obnoxious and contemptuous press release.”
The rejoinder reads;
REJOINDER TO OFFICIAL PRESS RELEASE ISSUED BY MEMBER REPRESENTING NNEWI NORTH CONSTITUENCY HON. SIR, AUGUSTINE ONYEKACHUKWU IKE TITLED “DETENTION OF MRS. NGOZI UBA, HER CHILDREN AND OTHERS: MEMBER REPRESENTING NNEWI NORTH CONSTITUENCY CONDEMNS THE RECENT ACTIVITIES OF NIGERIA POLICE FORCE JUDICIARY STAFF IN NNEWI”.
The attention of the office of Legal Adviser; Nzuko-Ora Nnewi (Town union) has been drawn to the above press release issued by member representing Nnewi-North constituency in Anambra State House of Assembly dated 10th day of October 2024 address to you; the Executive Governor of Anambra State, His Excellency Prof. Charles Chukwuma Soludo, CFR and others and it is very pertinent and germane for the office of the Legal Adviser of the town union to put up this rejoinder to avoid the evil of one sided story and spreading of falsehood and championing of procured eum centrated agenda in the bogus name of representative oversight which is outside his constitutional mandate in the following ways:
That by virtue of Part II of the Constitution of Federal Republic of Nigeria 1999 (as amended) powers of the Federal Republic of Nigeria is provided for under Chapter 4, the Legislative Powers, Chapter 3, the Executive powers and Chapter 6, the Judicial Powers. Therefore, as a member of House of Assembly, Hon. Sir. Augustine Onyekachukwu Ike ought to have known that the purported press release is contemptuous Ex-facie curiae because the cases he mentioned in his press release are subjudice.
That in as much as the office of the Legal Adviser is not holding brief for the Nigeria Police who are in the Executive Arm of the Government and . capable of defending themselves from the allegations, I am constrained not to discuss the issues that are pending before the courts, but to put the record straight and clear even to the blind to see to avoid misrepresentation of facts and biased narrative and urge His Excellency and other persons mentioned in the press release to disregard as bunkum, carnous and brutumfulmen the purported press release.
That the said press release shows contempt and expressing total disdain and lack of respect to the court and thereby bullying, intimidating and maligning the court particularly His Worship for performing her constitutional duty as a Magistrate.
+ Without prejudices; Mrs. Ngozi Vivian Uba’s two children were on bench warrant in Charge No: NMC/63c/2023 before they were brought to court and bail is at the discretion of the court and court of law is not a court of sentiment, and court do not administer justice in the abstract and the justice administered by the court is justice in accordance with the law. It is on record that His Worship did what the law provides and the Defendant has the right either to approach the same court for variation of bail condition or appeal against the ruling and not to reduce our court to a market place. It is our duty and responsibility to defend and protect our Judges and our Institutions and those with genuine complaint against a Judicial officer should activate the mechanism provided under the law for a redress and such an erring officer should be disciplined in accordance with the law and not by social media as in the instant case.
It is our prayer that Hon. Sir. Augustine Onyekachukwu Ike is compelled by Rt. Hon. Somtochukwu Nkem Udeze, the speaker, Anambra State House of Assembly to retract the obnoxious and contemptuous press release geared towards tarnishing the Image of our courts in Nnewi in order to conjure and intimidate them from freely preforming their constitutional duties in accordance to their Oath of office.
That we shall not hesitate to institute a contempt proceedings and other actions against him for the abuse of his office, threatening and for the attempt to interfere in the administration of Justice in Nnewi. Finally, in clear words, what Hon. Sir. Augustine Onyekachukwu Ike has done in his press release is to incite the people of Nnewi against the judiciary. This action must be condemned in a strongest term as it does not represent or demonstrate that he has respect for separation of powers. A system where judiciary is cowed and intimidated by politicians would be hell on earth for the people.
Your Excellency Sir, there is no gainsaying that you are the Chief custodian of the State especially in terms of security and well-being of the people. We urge you most fervently not to allow Hon. Sir. Augustine Onyekachukwu Ike to incite breakdown of law and order in Nnewi which his press release intends to achieve, but we know that you cannot tolerate such under your watch, hence this rejoinder.
