Full Decision Of NBA Branch Election Appeal Committee (North)

1.0 PREAMBLE.
This committee was set up by the proclamation of the President of the NBA on Monday 29th May, 2023.
Members of the committee are:

2.0 PETITIONS AND COMPLAINTS

The Committee received the following eight Petitions from Bwari Branch
1. Maxwell Okpara & 3 Ors Vs Chidi Dimgba
2. J. O. Thomson Vs Ability Tom Udoh
3. Paul Eboigbe Vs Electoral Committee
4. Juliet Arnoodo Vs Electoral Committee
5. Hajara T. Gbolagade Vs Electoral Committee
6. Owowo Caleb Vs Chinyere Moneme
7. Chinyere Moneme V Owowo Caleb
8. Rex Onekadiri vs Electoral Committee

2.1  The Appeal Committee sat on Monday 12th June, 2023 in Abuja considered the Petitions and decided as follows:

3.1  MAXWELL OKPARA & 3 ORS VS CHIDI DIMGBA.    
DECISION:
On the basis of the foregoing and in view of the fact that the Branch did not hold up to 12 meetings in the past twelve months, all candidates earlier disqualified on the basis of failure to make five attendances out of the last eight meetings be cleared to contest.
RECOMMENDATION
It is further recommended that the branch should procure hard cover attendance register to ensure consistency and regularity in record keeping of the attendance.

3.2  J.O THOMSON VS ABILITY TOM UDOH  DECISION.
This Committee hereby resolved that any contestant/member who attended four meetings from April 2022 to date is qualified to contest/vote as the case may be.  Ability Tom Udoh is therefore qualified to contest.
3.3 PAUL EBOIGBE VS ELECTORAL COMMITTEE 

DECISION
The Committee after listening to the petitioner respondent, Secretary of the branch and the Electoral Committee decided/held that the branch should continue with the zoning arrangement in the interest of fair play, peace and unity. The Branch should also provide, keep and maintain a proper attendance register.
RECOMMENDATION
The Committee recommends that the branch should go ahead with the zoning formula as it is the secure pattern used in the whole of FCT branches in order to have all inclusive branch as agreed by all the parties.
3.4 JULIET ARNOODO VS ELECTORAL COMMITTEE
And
3.5 HAJARAT T. GBOLAGADE VS ELECTORAL COMMITTEE OF NBA BWARI.
DECISION:  To promote peace and harmony, all contestants who made 4 attendance from April 2022 to date should be allowed to contest. Juliet Arnoodo and Hajara T. Gbolagade should be allowed to contest.
3.6 CALEB OWOWO VS CHINYERE MONEME 

DECISION: Nominators are financial members of the branch. The zoning arrangement of the branch is for the aspirant only and not applicable to the nominators. Respondent is eligible to contest.
3.7 CHINYERE MONEME VS CALEB OWOWO DECISION This allegations bother on forgery and therefore criminal in nature. This committee is not in a position to investigate criminal allegations.
3.8 REX ONYEKADIRI V ELECTORAL COMMITTE.
DECISION Payment of welfare levy is not time bound. The petitioner is eligible to contest for the position.       CONCLUSION.
It was found as a fact that the Executive Committee of NBA Bwari Branch did not hold up to 12 meetings in the last one year as required by the Uniform Bye Laws for Branches. Bwari branch held only eight meetings.
Record of attendance of the branch were found to be kept in loose sheets.
There were
inconsistencies and irregularities in the attendance sheets provided to the Appeal Committee. It is therefore, recommended that all contestants and eligible voters who attended at least four meetings from April 2022 to date should be allowed to contest and vote candidate of their choice.
