Daniel Kip Sues NDLEA.

DANIEL KIP FILES PUBLIC INTEREST SUIT AGAINST THE NATIONAL DRUG LAW ENFORCEMENT AGENCY (NDLEA).
The immediate past Assistant General Secretary of the NBA who is also a Rights Activist has initiated a public interest suit against the National Drug Law Enforcement Agency for violating the rights of commuters in Cross River State and at large.
In Suit No. FHC/CA/FHR/66/2024 filed at the Calabar Judicial Division of the Federal High Court, Daniel Kip is amongst others, seeking a declaration that the mounting of road blocks, and the stop and search conducted on the body, bag, and pockets of commuters and passengers while restraining their movement, by the agents and officials of the NDLEA, after demanding that they alight from their commercial or private carrier conveying them to their various destinations, thus subjecting them to public ridicule, abuse, molestation, intimidation, and harassment, while going about their lawful duties, is wrongful, unlawful, unconstitutional, and a violation of their fundamental rights to privacy, freedom of movement, dignity of human person, and not to be subjected to cruel or inhuman treatment, as guaranteed by  the Constitution of the Federal Republic of Nigeria, 1999 (as amended), the United Nations Declaration of Human  and Peoples Rights and the African Charter on Human and People’s Rights (Ratification and Enforcement) Act Cap A49, Laws of the Federation of Nigeria,
2004.It is the case of the Applicant that on several occasions, men of the NDLEA have been stationed at a certain location in Calabar,
mounting road block, and stopping Vehicles and conducting searches on the body,
pockets and carry-ons of commuters after having everyone in such commercial carriers
alight from same. And this exercise is carried out in the open glare with passersby and
Vehicles driving past and watching.
Daniel Kip further states this unlawful exercise has been consistent and that a serving corp Lawyer in his Firm was also subjected to the ridiculous exercise. He further asserted that in the course of this unlawful exercise by Officers of the NDLEA, the said commuters who are made to stand in the open, are arbitrarily detained, restrained and denied to freely move until every single person in the commercial carrier is searched, before the
Vehicle can move.At the time of this publication, it was understood that the NDLEA is yet to react to the originating process and it is yet to be confirmed if the Agency has been served. We will update on the outcome of this Suit eventually.
