NBA Branch Elections Appeal Committee (North) chaired by Abdul Atadoga Ibrahim SAN, met on Wednesday 14th August, 2024 to sit on Petitions against the decision of NBA Damaturu Branch’s Electoral Committee and reached the following decision:
that Nigerian Bar Association Damaturu Branch election conducted on the 10th day of August 2024 which was not conducted in compliance with the Constitution of the NBA is hereby declared as null, void and of no effect. The election is hereby set aside.
2. The purported return by the Electoral Committee led by Usman Nuhu Lukman and all the persons purportedly returned including or known as M. M. Ngumurumi, Esq led Executive Committee of Damaturu Branch that emerged on the 10th day of August 2024 are directed not to parade themselves as the Executive Committee members of the NBA Damaturu Branch henceforth.
3. The invocation of the doctrine of necessity to conduct election is wrongful and unknown to the Constitution of this noble Association. There is no provision of the law that empowers anyone or group or branch to set aside any of the requirements of the election guidelines for qualification. See especially Article 15(3) of the Uniform Bye-Laws for Branches.
5. It is the recommendation of this Appeal Committee that the President of the Nigerian Bar Association should constitute and appoint a Caretaker Committee.
6. That all the other petitions emanating from Damaturu branch shall abide by the decision of this Committee.
7. That any further attempt by the aforesaid persons led by M. M. Ngumurumi, Esq to parade themselves as the Executives of NBA Damaturu Branch should be referred to the Legal Practitioners Disciplinary Committee.
