NBA Effurun Seeks To Jail AG Delta State & 2 Others.

The Nigerian Bar Association Efurun Branch, Delta State,  has appealed to the Assistant Director of Court, High Court of Justice, Ughelli, to cause Form 48 (NOTICE OF CONSEQUENCES OF DISOBEDIENCE OF ORDER OF COURT), to be issued and served on, the Director, Directorate of Transport Delta State for continuous disobedience of the judgment of the High Court of Delta State holden in Ughelli, in the matter of SUIT NO: UHC/186/2014; OLUKUNLE OGHENEOVO EDUN, ESQ. Vs. THE GOVERNOR OF DELTA STATE OF NIGERIA & 2 Others. The Court had on 13th day of January, 2017, entered judgment in favour of the Claimant; 1.Declaration is hereby made that the: Road Traffic Law Cap. R9 Vol. 4 Laws of Delta State and Regulations made under the said Law did not authorize the Defendants particularly Vehicle Inspection Officers V.I.O set up road blocks and curry offensive weapons while carrying out their duties under the Law.

2.Declaration is hereby made that the aforesaid Road Traffic Law and subsequent subsidiary legislation made there under did not make…any provision lo entitle the Defendants particularly Vehicle Inspection Officers V.I.O.s to demand.or collect any fee, charge, levy or whatever name  called for the issuance of a Certificate of Road.
